Waste Collection Acton Terms and Conditions

These Terms and Conditions govern the provision of waste collection services by us to you in Acton and the surrounding areas. By booking or using our waste collection services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means the person, business, or organisation requesting or receiving our waste collection services.

Company, we, us, or our means the waste collection service provider supplying the services described in these Terms and Conditions.

Services means the waste collection, clearance, removal, transport, and related services provided by us in Acton and nearby areas.

Waste means any materials, items, rubbish, refuse, or junk presented to us for collection and disposal, whether domestic, commercial, or garden waste, subject to applicable laws and restrictions.

Booking means any order placed by the Customer for Services, whether by telephone, email, online form, or any other method accepted by us.

2. Scope of Services

We provide scheduled and one-off waste collection services for domestic and commercial customers in Acton and surrounding locations. The specific nature of the Services, including the types and volume of waste to be collected, collection date and time, and location, will be agreed at the time of Booking.

We reserve the right to refuse any waste collection where the waste is unsuitable, hazardous, illegal, excessively heavy, or not in accordance with UK waste regulations or our licence conditions. We may also refuse collections where access is unsafe or impractical.

Our Services are limited to the collection and transport of waste to authorised facilities. We are not responsible for cleaning, repairs, or remedial works beyond the scope expressly agreed in writing.

3. Booking Process

You may request a Booking by contacting us by telephone, email, or through our online enquiry or booking system, where available. When making a Booking, you must provide accurate and complete information, including:

1. Your full name and contact details
2. The collection address in Acton or surrounding areas
3. The type and approximate volume or weight of waste
4. Any access restrictions, parking limitations, or special requirements
5. Preferred collection date and time window

We will provide you with an indicative quote based on the information you supply. All quotes are given in good faith but are subject to confirmation on arrival when our team can inspect the waste and access conditions. If the waste differs significantly from the description provided or if there are unforeseen access issues, we may adjust the price accordingly or refuse the collection.

Your Booking will be confirmed only when we expressly accept it, whether verbally or in writing. We reserve the right to decline any Booking at our sole discretion.

4. Pricing and Quotations

Prices for our Services are generally based on the volume, weight, and type of waste, the labour required, and access or parking conditions in the Acton area. Quotations provided in advance are estimates only and are subject to change once we assess the waste on site.

Unless explicitly stated otherwise, prices are quoted inclusive of standard disposal charges but may exclude additional fees or surcharges for:

1. Hazardous or specialist waste
2. Items requiring special handling or dismantling
3. Extra labour where access is difficult
4. Extended waiting time caused by you or your representatives
5. Parking charges, congestion charges, or penalties incurred as a result of restrictions beyond our control

We will inform you of any price adjustments before starting the work wherever reasonably possible. If you do not accept the revised price, you may cancel the Booking, but you may still be liable for a call-out or cancellation charge as set out in these Terms and Conditions.

5. Payments

Payment terms will be confirmed at the time of Booking. Unless agreed otherwise in writing, payment is due immediately upon completion of the waste collection service.

We may accept payment by cash, debit or credit card, bank transfer, or other methods notified by us. For commercial Customers, we may, at our discretion, offer account facilities with agreed payment terms, subject to satisfactory credit checks.

All sums are payable in pounds sterling. If any payment is not made when due, we reserve the right to:

1. Charge interest on overdue amounts at the statutory rate applicable in England and Wales, accruing daily until full payment is received
2. Suspend or cancel any further Services
3. Recover from you all reasonable costs and expenses incurred in pursuing the debt, including legal and collection costs

Ownership of any collected waste transfers to us only when full payment is received, except where we are required by law to handle or process the waste regardless of payment status.

6. Customer Obligations

You are responsible for:

1. Providing accurate information at the time of Booking regarding the type and volume of waste and the access conditions at the collection address
2. Ensuring that we have safe, adequate, and lawful access to the premises, including arranging parking permits or access codes where necessary
3. Ensuring that waste to be collected is clearly identified, properly bagged or contained where appropriate, and does not include prohibited or hazardous materials unless disclosed and agreed in advance
4. Obtaining any necessary permissions from landlords, neighbours, building managers, or local authorities for access or waste removal
5. Supervising the collection if required and ensuring that any instructions you give to our staff do not conflict with health and safety laws or these Terms and Conditions

If we are unable to carry out the collection due to your failure to fulfil these obligations, we may charge a wasted journey or cancellation fee to cover our time and costs.

7. Cancellations and Amendments

You may cancel or amend a Booking by contacting us as soon as possible. The following terms generally apply, unless otherwise stated at the time of Booking:

1. If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually apply.
2. If you cancel within 24 hours of the scheduled collection time, we may charge a reasonable cancellation fee to cover our administration and scheduling costs.
3. If our team arrives at the collection address and is unable to complete the work due to your act or omission, including unavailability, access issues, or incorrect information, we may charge a call-out or wasted journey fee.

We will use reasonable efforts to accommodate requests to change the date, time, or scope of Services, but we cannot guarantee availability. Changes may result in revised pricing.

We reserve the right to cancel or reschedule a Booking at any time due to circumstances beyond our control, including adverse weather, vehicle breakdown, staff illness, or regulatory issues. In such cases, we will inform you as soon as reasonably practicable and offer an alternative time or a refund of any pre-paid amounts for Services not delivered. We are not liable for any indirect or consequential loss arising from such cancellation or rescheduling.

8. Waste Types and Prohibited Materials

We collect general household, commercial, and garden waste in accordance with applicable UK waste management laws and regulations. Certain items and materials are prohibited or restricted, including but not limited to:

1. Hazardous waste such as chemicals, solvents, paints, asbestos, clinical or medical waste, and certain electrical items
2. Explosives, gas cylinders, and pressurised containers
3. Large quantities of liquid waste
4. Any substances or items classified as dangerous under relevant regulations

You must inform us in advance if your waste includes any items that may be hazardous, regulated, or require special handling. We may, at our discretion, agree to collect such items subject to additional charges and compliance with all legal requirements.

If prohibited or undisclosed hazardous materials are discovered among your waste, we may refuse to remove them, adjust our charges, or terminate the Service. You will be responsible for any costs, fines, or damages arising from your failure to disclose the nature of the waste.

9. Compliance with Waste Regulations

We operate in accordance with applicable UK waste regulations, environmental legislation, and local authority requirements for waste collection and disposal. We will transport and dispose of collected waste only at authorised facilities and will take reasonable steps to reuse or recycle materials where possible.

Where required by law, we will issue a waste transfer note or similar documentation for the collection and transfer of controlled waste. You agree to provide any information reasonably requested by us to complete such documentation accurately.

You acknowledge that improper disposal of waste is a criminal offence and you must not ask or encourage us to dispose of waste unlawfully. We reserve the right to report any suspected illegal activity to the relevant authorities.

10. Access, Parking, and Site Conditions

You must ensure that our vehicles and staff can safely access the collection site. This includes providing accurate directions, information about height or weight restrictions, and any parking limitations in the Acton area.

Where permits or paid parking are required, it is your responsibility to arrange them in advance or reimburse us for any reasonable parking charges or fines incurred as a direct result of restricted access or incorrect information provided by you.

We are not responsible for damage caused to driveways, paths, or underground services where you have directed us to access areas not designed for heavy vehicles or equipment. You should notify us in advance of any relevant risks or limitations.

11. Liability and Limitations

We will perform the Services with reasonable care and skill. However, our liability to you is subject to the following limitations to the fullest extent permitted by law:

1. We are not liable for any indirect, consequential, or economic loss, including loss of profits, business, goodwill, or anticipated savings, arising out of or in connection with the Services.
2. We are not liable for any loss or damage resulting from inaccurate information provided by you or your failure to comply with these Terms and Conditions.
3. We are not liable for any pre-existing damage to property or items, or for fair wear and tear.

Our total liability for any loss or damage arising from the Services, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by you for the specific Booking to which the claim relates.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

12. Customer Property and Personal Items

You must ensure that any personal belongings or items that you do not wish to be removed are separated from the waste before our team begins work. We will not be responsible for items taken away as waste if they were not clearly identified or separated.

If you believe that personal property has been removed by mistake, you must notify us as soon as possible. We will make reasonable efforts to locate and recover the item, but we cannot guarantee its return and will not be liable for any loss arising from such removal.

13. Data Protection and Privacy

We will collect and process your personal data in order to manage your Booking, provide the Services, and handle payments and communications. We will take reasonable steps to protect your data and will not share it with third parties except where necessary to deliver the Services, comply with legal obligations, or with your consent.

You have the right to request access to the personal data we hold about you and to ask for corrections where necessary. Any data processing will be carried out in accordance with applicable UK data protection laws.

14. Force Majeure

We shall not be liable for any delay in or failure to perform the Services due to events beyond our reasonable control, including but not limited to extreme weather, natural disasters, war, civil unrest, strikes, lockouts, labour disputes, pandemics, transport disruption, or interruption of utilities.

In such circumstances, we may suspend or cancel the affected Services and will endeavour to notify you as soon as reasonably practicable. Where possible, we will offer an alternative date or solution, but we are under no obligation to provide compensation for delays or cancellations arising from force majeure events.

15. Variation of Terms

We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when posted on our website or otherwise communicated to you. The terms applicable to your Booking will be those in force at the time you place the Booking, unless a change is required by law or regulatory authority.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by any court or competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste collection services.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of Booking, constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings, agreements, or representations, whether oral or written.
